The Holland Law Firm, P.C. together with Scott Borison of the Legg Law Firm, LLC filed a putative class action against the Maryland Management Company and several other entities. The complaint alleges that they sued beyond the 3 year statute of limitations when they filed lawsuits to collect consumer debt for the alleged breach of residential leases. The lawsuit alleges that, pursuant to the holding by the Maryland Court of Appeals in Smith v. Wakefield, LP, (which was also handled by the Holland Law Firm and Legg Law Firm) the statute of limitations in a residential lease in Maryland is 3 years, regardless of any provision the landlord inserted stating it is 12 years.
